By creating an account or using ExamSync (“the Service”), you agree to these Terms of Service (“Terms”). If you register on behalf of an institution, you confirm you are authorized to bind that institution to these Terms.

If you do not agree, you must not use the Service.

2. Description of Service

ExamSync is a cloud-based application that assists educational institutions in managing examination timing, announcements, and coordination across devices.

The Service is a support tool only and does not replace official examination regulations, invigilator duties, or institutional procedures.

3. Institutional Use

The Service is intended for use by educational institutions and authorized staff.

The institution is responsible for:

  • All activity under its account
  • Maintaining confidentiality of access credentials
  • Ensuring authorized use only
  • Accuracy of information entered into the Service

4. User Responsibilities During Examinations

The institution retains full responsibility for:

  • Compliance with examination rules and regulations
  • Correct configuration of exam timings
  • Monitoring candidates
  • Delivering official instructions
  • Verifying displayed times and announcements

Use of the Service does not transfer responsibility for examination administration.

5. Acceptable Use

You agree not to:

  • Use the Service unlawfully
  • Attempt unauthorized access to data or systems
  • Interfere with operation or security
  • Reverse engineer or copy the Service
  • Use the Service to disrupt examinations

6. Availability

The Service is provided on an “as available” basis.

Interruptions may occur due to:

  • Internet outages
  • Power failures
  • Device malfunctions
  • Third-party service disruptions
  • Maintenance

Institutions should maintain appropriate backup procedures where required.

7. Fees (If Applicable)

Paid plans are billed according to the selected subscription.

Failure to pay may result in suspension or termination of access.

8. Intellectual Property

All software, design, and content remain the property of ExamSync or its licensors.

You receive a limited, non-exclusive right to use the Service for institutional purposes.

9. Suspension and Termination

We may suspend or terminate access if:

  • Terms are violated
  • Security risks are detected
  • Payment obligations are not met
  • Required by law

Institutions may stop using the Service at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided “as is” without warranties of any kind.

ExamSync shall not be liable for:

  • Examination outcomes
  • Loss of exam time
  • Incorrect configurations
  • Data loss
  • Service interruptions
  • Device or connectivity failures
  • Indirect or consequential damages

Total liability shall not exceed fees paid for the Service in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless ExamSync from claims arising from:

  • Your use of the Service
  • Violation of these Terms
  • Failure to follow examination regulations
  • Actions of your staff

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service provider is established, unless otherwise required by applicable law.
